Restore Your Status
f you’re in Canada to visit, work or study temporarily, you need to have valid status as a temporary resident. If your status has expired, you may be able to apply restore your status.
You can only restore your status and authorization to work or study in Canada to what you held before it expired. You can’t change your permit until you restore your status and original authorization. If you’re eligible after restoration, you may also be able to apply for a different permit.
If it’s been less than 90 days since your status expired
You can apply to restore your status.
To restore your status, use the document checklist and guide for extending your stay as a
- visitor
- student
- worker
If your temporary resident status is restored, you’ll get a visitor record or appropriate permit. Your record or permit will outline the conditions of your stay in Canada.
Your temporary resident status in Canada will be extended until a specified date.
Eligibility requirements for restoration of status
The applicant must
- apply within 90 days of having lost their status
- meet the initial requirements for their stay
- remain in Canada until a decision is made
- have not failed to comply with any condition imposed automatically by regulation [R183] or by an officer [R185], other than those stated below
- have lost their status only because they have failed to comply with any of the following conditions imposed by an officer:
– paragraph R185(a)
The period authorized for their stay.
– subparagraphs R185(b)(i) to (iii)
The work that they are permitted to engage in, or are prohibited from engaging in, in Canada, including the
– type of work
– employer
– location of work
– paragraph R185(c)
The studies that they are permitted to engage in, or are prohibited from engaging in, in Canada, including the
– type of studies or course
– educational institution
– location of the studies
– times and periods of the studies
- continue to meet the requirements of a temporary resident and the requirements of the work or study permit, as applicable
